Ertyad Training Company Platform — Kingdom of Saudi Arabia
Subject of the Contract
- Ertyad Training Company operates an online registration platform (“the Platform”), currently available at https://www.tadarab.org/ar/, which offers online services from service providers. The Platform enables conclusion of service agreements with providers, and offers features for streamlined registration and deregistration. The Service Provider provides the service at a specified time or during a specified period. Enrollment is effected by the Beneficiary’s registration on Ertyad’s electronic registration platform. https://www.tadarab.org/ar/
- The service agreement is concluded only between the Service Provider and the Beneficiary. The Service Provider alone is responsible for execution, scope, and content of the service. Therefore, any complaints related to the service must be directed exclusively to the Service Provider.
Preamble
The following general terms and conditions apply to all business relationships between the User, the Beneficiary, Ertyad, and the Service Provider arising from the use of the online platform “Ertyad” (hereinafter referred to as the “Services”) and the conclusion of service agreements. In each case, the version in effect at the time the contract is concluded shall govern. Differing, conflicting, or supplementary terms and conditions — even if known — shall not be part of the agreement unless Ertyad explicitly agrees to them in writing. Ertyad explicitly rejects the Beneficiary’s terms and conditions. The Beneficiary will be notified of amendments to the terms and conditions; such amendments shall be deemed accepted unless the Beneficiary objects in writing within fourteen (14) days. The Beneficiary will be expressly informed of the importance of confidentiality during communications. All other information, customer service, data handling, and complaint procedures are provided in both Arabic and English.
Registration
(a) Registration to subscribe to services takes place via https://www.tadarab.org/ar/. The Beneficiary must complete the service-specific registration form. After submission and payment of the service fee, the Beneficiary will receive electronic confirmation at the provided email address. This confirmation includes the invoice and payment confirmation (PDF), beneficiary data, service details, and the identification number. Upon receipt of this electronic registration confirmation by the Beneficiary, the agreement between Ertyad and the relevant Service Provider is concluded.
(b) Each registration is binding. Cancellation is possible only in accordance with Section 6 of these General Terms and Conditions.
(c) Successful registration and proper payment entitle the Beneficiary to access the relevant service, without prejudice to Section 7 of these General Terms and Conditions.
Service Fee
The service fee is set by the Service Provider and Ertyad has no influence on that fee. The service fee already includes all applicable charges, taxes, Ertyad platform commission, and payment transaction fees. The fee is shown as a total amount during registration unless otherwise stated by the Service Provider, and must be paid by the Beneficiary to Ertyad, which collects it on behalf of the relevant Service Provider.
Payment
(a) During registration the Beneficiary must choose a payment method (credit card, PayFort, or advance payment/invoice). Payment must be made immediately upon registration. A valid registration requires payment. The Beneficiary will not receive the registration confirmation under Section 2(a) unless registration and payment are completed.
(b) For credit card payments, the charge usually posts within seven (7) days. When paying by credit card the customer provides card number, expiry date, and card verification code (CVV). Data are transferred using secure socket layer encryption with at least a 256-bit key, so data are not visible to unauthorized persons. Processing is performed by a PCI-DSS certified payment service provider (PayFort). If the Beneficiary’s name differs from the cardholder’s name, Ertyad reserves the right to cancel the contract within seven (7) days of registration (= date of submission). In all cases, the Beneficiary shall — without prejudice to any further claims — reimburse Ertyad the full service fee if payment was incorrectly executed by another party or was not made by the payer.
The service fee is collected by the payment option selected during checkout.
Statutory default interest applies in the event of late payment. In case of default, the Service Provider is entitled to an amount per reminder notice.
Ertyad reserves the right to continue platform services provided the outstanding claim due to the Service Provider is settled; Ertyad may suspend an account after a first notification and a 14-day grace period. Suspension does not affect the Beneficiary’s duty to pay the service fee.
Pre-registration and Waiting List
If at registration the Beneficiary finds the requested service fully booked, the Beneficiary may opt to be placed on the waiting list. The Beneficiary is automatically advanced in order when relevant changes occur prior to them in the queue; when the service becomes available the Beneficiary is notified electronically. In that case the contract is concluded only upon the Beneficiary’s receipt of the electronic notification. No fees apply for pre-registration or joining the waiting list.
Course Attendance Policies
A trainee must attend at least 75% of the total training hours of the registered course. Remote/virtual attendance counts as regular attendance. If a trainee is absent from the course, they forfeit the right to a refund; the fee remains as credit with the training entity to be used for another course.
Cancellation by the Beneficiary
If the Service Provider authorizes automatic cancellation via Ertyad, the following rules apply. If automatic cancellation is not authorized, responsibility for the agreement lies solely with the Service Provider and the Beneficiary under the Service Provider’s general terms and conditions.
(a) Cancellation before the registration deadline
If the Service Provider has not specified a cancellation deadline, cancellation of registration is possible only up to 72 hours before the registration deadline (for example: if the registration deadline is 15/3 at 5:00 PM, cancellation is possible until 12/3 at 5:00 PM), as previously defined by the Service Provider and visible on the online registration portal. Cancellation can be made via Ertyad’s online portal by clicking “Cancel” in the Beneficiary’s booking overview. If cancellation is submitted through another means it must include the identification number from the registration confirmation plus the bank details (IBAN and SWIFT) of the person whose registration is being cancelled. Without this ID, cancellation is not possible. If registration is cancelled by the Beneficiary more than 72 hours before the registration deadline, Ertyad may charge a 5% cancellation fee of the relevant service. Ertyad will refund the remaining amount to the Beneficiary’s selected bank account.
(b) Services without a specified registration deadline
For services that do not have a registration deadline specified by the Service Provider, cancellation via the Platform is not available.
(c) Cancellation from the waiting list
by clicking “Cancel” in the booking portal, which cancels the reservation. No fees apply.
(d) Subsequent cancellation (late cancellation)
Cancellations after the 72-hour window before the registration deadline are not technically supported by the Platform. If the relevant Service Provider individually allows cancellation after the 72-hour window, such cancellation must be made directly through the Service Provider.
Service Cancellation by the Service Provider
The Service Provider is responsible for canceling services it provides. In that event all claims by the Beneficiary must be directed to the Service Provider.
Service Cancellation by the Service Provider
In case of cancellation of a service, Ertyad is entitled to receive a commission from the Service Provider based on the service fee. The Service Provider may decide whether to pass this commission on to the Beneficiary. If the commission is charged to the Beneficiary, the Beneficiary will be informed of the actual commission amount during registration and before the contract is concluded.
Distance Transactions (Remote Contracts)
(a) Services with a fixed registration deadline Ertyad organizes services that may fall under the exceptions in the Saudi Consumer Protection Law regarding events/services at a specified time; therefore the participant may not have the statutory right of withdrawal for such scheduled services. (b) Services without a fixed registration deadline or product purchases The statutory withdrawal period for distance contracts is two (2) weeks. For services without a fixed registration deadline or for product purchases, the period starts from the date the contract is concluded. The day the contract is concluded (or received by the customer) is not counted as the first day. If the consumer withdraws from the contract, the Service Provider shall make reasonable efforts to refund payments made by the consumer and cover necessary expenses related to the withdrawal. The consumer must stop using received services and pay an appropriate fee for usage, including compensation for any reduction in average value of the service. Receipt of services by itself does not constitute automatic depreciation.
(a) With respect to its platform services (but not for fulfilling "service agreements")
Ertyad provides the Platform to meet general public requirements and needs. Ertyad assumes no warranty or liability regarding the suitability, regularity, accuracy, or completeness of provided services, nor for a specific intended use. Ertyad is not liable to the User for any interruption, failure, delay, deletion, transmission error, or memory failure relating to the use of the Services or communications.
Ertyad’s liability (and that of its executive bodies, employees, contractors, or agents — collectively “Persons”) is generally limited to cases of gross negligence or willful misconduct; liability for simple negligence is excluded. This disclaimer does not apply to personal injury or damage to property that Ertyad had reason to consider. Where Ertyad’s liability is limited or excluded, the same applies to personal liability of its affiliated “Persons.”
(c) Ertyad is responsible only for its own content. While Ertyad may provide links to third-party websites, Ertyad is not responsible for the foreign content of those sites and does not claim ownership of such content. If a user believes linked external content infringes their rights, please report it to support@sajil.org.
Other Provisions
(a) If any individual contractual provision of this contract is or becomes invalid (in whole or in part), or an omission is discovered, the remaining provisions shall remain in force.
(b) This agreement governs the contractual relationship between the contracting parties. Oral agreements become void upon conclusion of this contract.
(c) Amendments or additions to this contract must be made in writing. This also applies to any waiver of the written form requirement. Communications sent via email, fax, or information forms meet the written form requirement.
(d) References to natural persons in the masculine form shall include both women and men equally. When referring to specific natural persons, the appropriate gender form should be used.
Applicable Law / Jurisdiction / Place of Performance
(a) Saudi law shall apply to this contractual agreement.
(b) The courts competent in the Kingdom of Saudi Arabia shall have exclusive jurisdiction for any disputes arising directly or indirectly from this contract. If the User is a consumer, jurisdiction is agreed only if the User has a habitual residence or place of employment within the court’s district or resides abroad; in all cases jurisdiction in Saudi Arabia is agreed.
(c) The place of performance of contractual obligations is the Kingdom of Saudi Arabia.
(d) Ertyad acts as an Internet ombudsman and out-of-court arbitration board. For further questions regarding dispute resolution, Users may contact support: support@sajil.org.
General Terms & Conditions for Service Providers on the Ertyad Platform

- Under this contract the Service Provider appoints the Agent to mediate and conclude bookings between the Service Provider and Beneficiary. The mediation and booking are undertaken in the name and on behalf of the Service Provider. The Agent performs its activities based on this commercial agency contract.
- The Agent is commissioned to provide services via the Platform or via tools in the name and on behalf of the Service Provider worldwide. The Agent retains the right to work for other Service Providers.
- The Agent collects the service fee set by the Service Provider and transfers it — after deducting the commission (see Clause 5) — to the Service Provider within one (1) month after start of service. The Service Provider receives an invoice for the commission.
Agent Rights and Obligations
- In particular, the Service Provider authorizes the Agent to: (a) conclude the service agreement, (b) issue invoices, (c) collect the service fee, and thus (d) act as payment agent and (e) refund service fees in case of cancellations.
- The Agent shall protect the Service Provider’s interests with the care of a prudent businessperson. The Agent is obligated to observe and comply with rules of fair competition at its own responsibility.
- The Agent commits to protect and maintain confidentiality of trade secrets and business secrets of the Service Provider that become known in the course of its activities.
- The Agent reserves the right to cease providing certain services if they are unlawful, unethical, or substandard. The Agent will notify the Service Provider immediately.
Service Provider Obligations
- The Service Provider provides services at its own responsibility.
- To enable the Agent to perform its role successfully, the Service Provider must provide and update comprehensive information (“Content,” e.g., texts and images) as needed. The Service Provider guarantees that no provided content will, by its disclosure or publication, violate public law or infringe others’ rights. Racist, pornographic, inhumane, sexual, abusive, or defamatory content is expressly prohibited. The Service Provider guarantees that there are no conflicting rights (in particular copyright) of third parties with regard to the provided content. The Agent is not obliged to keep all content available or to check it for violations.
- The Service Provider alone is responsible for marketing materials, scope, and content of the service.
- The service agreement is concluded only between the Service Provider and the Beneficiary.
- By concluding this commercial agency contract the Service Provider warrants to the Agent that it complies with all relevant legal requirements regarding its services and is the operator of a legitimate business; the Service Provider warrants that services and service locations comply with legal standards. The Agent may not and will not verify this as part of its role.
Commencement and Termination of the Contractual Relationship
(a) The commercial agency relationship is not limited in term by default.
(b) The contracting parties may agree on minimum terms. When paid features (e.g., “Premium”, “Luxury” profiles) are used, the minimum contract term is one (1) month. Thereafter the usage period renews for similar periods. Paid features can be terminated monthly.
Right to Commission
- The Agent is entitled to a commission for concluding the service agreement. The commission claim arises when the total service fee has been paid by the participant and is due at that time.
- For bookings made via the Platform marketplace, the Agent is entitled to collect and retain 15% plus VAT of the total service fee for the Basic profile. For bookings via Ertyad’s booking interface (reservation widget), the commission rate is reduced to 6% plus VAT for the Basic profile.

- If the Service Provider concludes a paid contractual relationship (e.g., “Premium”, “Luxury” profiles), the commission rate is reduced as follows:
- Premium: booking interface 5% / marketplace 10% Luxury: booking interface 4% / marketplace 5%
- If a paid profile relationship terminates, the standard conditions for the Basic profile apply.
- The Agent’s commission right exists even if the commission (in absolute value) is less than one Euro; the Agent will still be entitled to a minimum net commission of EUR 1. There is no commission on free transactions and on manual bookings made by the Service Provider.
- The commission right remains as long as it is certain that execution of the contract between the Service Provider and the Beneficiary will not be canceled for reasons not attributable to the Agent.
- The Service Provider retains the right to cancel the service up to the registration deadline (see Clause 6). In that case the Agent will refund 100% of the already received service fee to the Beneficiary. Subsequent cancellations or terminations (by the client) or mutual terminations have no effect on the Agent’s commission right.
Content of the Service Agreement that Will Be Mediated / Concluded
- The Service Provider will specify to the Agent for each service whether automatic cancellation will be permitted. If the Service Provider does not allow automatic cancellation, the agreement and cancellation responsibility lie solely between the Service Provider and the Beneficiary under the Service Provider’s general terms.
- The registration deadline for each service is set by the Service Provider. By default, the Agent will agree with Beneficiaries that cancellation is possible up to 72 hours before the registration deadline. This default may be modified but must not be less than the 72-hour period.
- In case of cancellation, the Agent may deduct 5% of the total service fee plus 5% VAT per registration as a processing fee if no commission claims have been asserted by the Agent at that time. A minimum net amount of EUR 1 applies where the commission rate would be below that amount. The Agent will refund the remaining balance to the relevant Beneficiary.
- For services without a registration deadline set by the Service Provider, the Agent will not agree with Beneficiaries on any cancellation.
Warranty / Liability (Agent & Platform)
- Ertyad (the Agent/Platform) and its executive bodies, employees, contractors, or agents (“Persons”) shall generally be liable only in cases of gross negligence or willful misconduct; liability for slight negligence is excluded. This disclaimer does not apply to bodily injury or damage to property that Ertyad had reason to consider. Where Ertyad’s liability is limited or excluded, the same applies to personal liability of affiliated “Persons.”
- The Agent created the Platform to satisfy general public needs; therefore it assumes no warranty or liability regarding suitability, regularity, accuracy, or completeness of the services offered, and no warranty for specific intended uses. The Agent is not responsible to the Service Provider for any interruptions, malfunctions, delays, deletions, transmission errors, or memory failures in the use of the Platform.

- For all disputes arising under this contract (including prior and consequential effects), exclusive jurisdiction is agreed to be in the Kingdom of Saudi Arabia.
- Saudi law applies to this contractual agreement.
- If any individual contractual provision of this contract is or becomes invalid (in whole or in part), or an omission is discovered, the remaining provisions shall remain effective.
- This contract governs the contractual relationship between the contracting parties. Amendments or additions must be made in writing. This includes the waiver of written form; communications by email or fax satisfy the form requirement, as does pressing a relevant button.
- References to natural persons in the masculine form include both women and men equally. When referencing specific natural persons, the appropriate gender form should be used.
Academic Integrity
Ertyad commits to ensuring academic integrity of delivered educational content by protecting intellectual property, internally reviewing content to assure quality and currency, and enforcing learning policies that preserve confidentiality and observe public norms, laws, and national policies in any educational activities by trainers or trainees on the Platform. The Platform reserves the right to delete or block any user who violates usage rules, to delete user accounts that infringe others’ accounts or impersonate another, and to act upon detected cheating in assignments and exams
